We are committed to protecting your information and being transparent about what personal data we collect and how we use it, acting responsibly and in compliance with applicable data protection laws in Brazil (Law No. 13.709, of August 14, 2018) and the countries with which we do business.
What data we collect and how we collect it:
At Sabiá, we collect personal data with the authorization of data subjects for the following processes: prospecting and CRM management (Customer Relationship Management) commercial, customer service and relationships (including event management), media management (e.g., digital/online campaigns), vendor management, people management, and financial/accounting management. We only collect and process Personal Data about you when there is consent (whenever consent has been given), contract (when processing is needed to finalize the contract with you (e.g., to deliver the services your company has contracted for) and legitimate interests (when necessary for compliance with tax and accounting laws, for example). These data can be collected both offline and online. Online data is collected in a structured and identifiable manner through registration forms on our website and digital campaigns conducted in our own name. It is also collected from interactions with prospects, clients, suppliers, job candidates, and staff that occur via email, Trello boards, WhatsApp, or in work meetings. Additionally, we use cookies (not the baked goods, but “web beacons”) and analytics tags to non-individually track your visit to our website and/or social media and digital campaign links. The offline information about you originates from our interactions with you, for example, during in-person meetings or at events, conferences, or workshops where we met and exchanged contact information (e.g., business cards). The data collected by us includes: name, surname, social media profile, email, phone number, company, job title, and geographic region. In situations where we have established business relationships, we may also collect information such as birthday, home address, and payment details. At Sabiá, we do not collect, process, or store sensitive data, nor do we collect data from children and adolescents. When we serve our clients as operators, not data controllers under their responsibility, we can collect data from email sending platforms, digital campaigns on social networks, and other sign-up forms.
How we use your personal data:
In general, the Personal Data we collect is used to respond to requests you make, or to help us serve you better. The Sabiá team may use your personal data, individually or collectively, collected as described above for the following purposes: > understand the needs of prospects and clients in order to offer commercial proposals and/or partnerships that align with their expectations; > improve our services; > to answer your questions and requests; > Formalize commercial agreements; > allow you to access and use the services you contracted with us when you represent a company; > Analyze the behavior and trends of users on our digital platforms and campaigns to improve our communication processes.; > to contact you: where you have asked us to do so or authorized us to do so, and whenever necessary to notify you about changes or updates to our services; > to relate and communicate with the team, our partners, and suppliers; > to carry out financial procedures, such as payments to suppliers and staff; > to manage event registrations. Furthermore, when we act as data processors on behalf of clients who are controllers, we use the Personal Data collected so that such clients can carry out the activities above.
How We Store and Share Personal Data:
Sabiá guarantees that it will not sell or rent your Personal Data to any person or company. Your data may be communicated to the Agência Sabiá team and to outsourced suppliers and service providers hired for the provision of financial services, media management, and/or other activities supporting our business and operations. All individuals with access to Personal Data that we control and/or operate have activity related to operations that require access to this information, which is described in the previous chapter, and receive guidance on legal requirements and internal procedures that ensure the confidentiality of their information. Additionally, we may disclose your personal data if necessary to prevent, detect, or investigate illegal or suspected activities, or to prevent other harm, or in response to legal action, or to enforce our rights and claims. Your Personal Data may also be accessed by any competent law enforcement or regulatory body, government agency, court, or other third party where disclosure is legally required. When we act as data processors for controller clients (when we create a communication campaign or an event for a client, for example), it is possible for data to be transferred to them. These clients may not always be based in Brazil, and could be located in other countries in the Americas – e.g., the United States, Mexico, Chile, Colombia, Argentina. In these cases, your authorization for the collection, processing, and storage of data will be obtained beforehand through your acceptance of the privacy policy of the responsible client. We also emphasize that the Personal Data you provide to us may be stored, processed, and/or transferred on digital platforms with access controls, some of them with cloud hosting outside of Brazil. Therefore, consider that Your Personal Data may be transferred and processed in countries other than the country in which you are located. These countries may have data protection laws that are different and potentially less protective than the laws of your own country.
How long we store your Personal Data:
Your Personal Data will be kept for the time necessary for the purpose for which it was collected. Sabiá commits to not retaining your personal information from the moment you request it, provided that it is not essential for the execution of established commercial processes or for compliance with applicable legal, audit, and accounting requirements, as well as for the resolution of demands related to judicial exercise or defense in the countries where we do business.
How to obtain information about your Personal Data controlled and/or operated by Sabiá. And how to modify or delete them:
You have the right to know if we hold information about you, and if so, the type of information, the purposes for which we hold it, and the possible recipients or types of recipients. You also have the right to access your personal information and to require that this information be corrected if it is inaccurate or incorrect. If you want information of a personal nature about your personal data, please send an email to privacidade@agenciasabia.com.br Through this channel, we will inform you about the confirmation of the existence of data processing and data access. You may also use this email channel to request the correction of incomplete, inaccurate, or outdated data, as well as to request anonymization, withdrawal of consent, blocking, or deletion of unnecessary, excessive, or improperly processed data. Upon written request and within a reasonable timeframe, we will correct, delete, and/or block personal information from any future use and processing. If your Personal Data is processed by us but controlled by our clients, your request will be forwarded to the controlling client. In addition to email, you can request the update or deletion of your information from the email marketing databases we control through the messaging platform we use to contact you for general agency communications.
Updates to Sabiá's Privacy Policy:
Sabiá may update this Privacy Policy periodically to reflect changes in our data governance practices. The revised Privacy Policy will be published at this same consultation link, with an updated revision date. We recommend that you periodically revisit this page for the most up-to-date information on our privacy protection practices. If we make a substantial change to what is presented here, we will publish a notice on our social media and have a post on our website's homepage for 30 days. By continuing to access our digital channels after such a revision takes effect, Sabiá will consider that you have read and understood the changes.
